HAGERSTOWN, Md. (WDVM) — A Pennsylvania man was taken into custody in West Virginia early Sunday morning after he reportedly shot and killed his girlfriend, the mother of his child, on Christmas Day in Maryland.
The Hagerstown Police Department says officers were called to 320 South Burhans Boulevard at approximately 6:30 p.m. on Saturday, Dec. 25 for a report of a person who had been shot.
Police say the shooting victim — identified as 37-year-old Tristan Shifflet of Hagerstown — was taken to Meritus Medical Center, where she later died from her injuries.
According to the department, investigators discovered that Shifflet’s boyfriend — 34-year-old Justin Kyle Marshall of Greencastle, Pa. — shot her during a fight, hitting her in the neck, and left the scene before officers arrived.
Authorities say Marshall was arrested at approximately 2:45 a.m. on Sunday, Dec. 26 by the Berkeley County Sheriff’s Department in West Virginia.
Police say there was also an active arrest warrant issued for Marshall through Pennsylvania State Police for assault following a separate incident involving Shifflet.
In addition, Marshall was convicted of second-degree murder in 2004 in relation to a non-domestic-related homicide in Hagerstown and had been out of prison for about two years before Saturday’s shooting, officials say.
According to authorities, the couple shared a young child together, but Washington County Child Protective Services took custody of the boy and made housing arrangements for him.
Marshall has been charged with first-degree murder — along with numerous related charges — in connection with Saturday’s incident and will reportedly be extradited back to Maryland.
