WASHINGTON, DC (WFXR) — Virginia Attorney General Mark Herring announced on Thursday a lawsuit to recognize the Equal Rights Amendment as the 28th Amendment to the U.S. Constitution.
The suit names the Commonwealth of Virginia as well as the states of Nevada and Illinois as plaintiffs. Virginia recently became the 38th state to ratify the Equal Rights Amendment. Nevada and Illinois ratified it in 2017 and 2018, respectively. The three states ratified the ERA after the 1982 deadline.
According to a document shared by Herring, the suit names David Ferriero, the Archivist of the United States, as the defendant. The suit asks the U.S. District Court for the District of Columbia to direct Ferriero to publish the Equal Rights Amendment as part of the Constitution.
“I really feel the weight of history in this case,” Herring said in a Thursday morning press conference.
