The alleged killer of a 13 year old Blacksburg girl was in Montgomery County Court this morning for what is expected to be his last pre-trail motions hearing.
David Eisenhauer is charged with abduction, first degree murder, and concealing a dead body.
He was arrested almost two years ago in the killing of 13 year old Nicole Lovell.
[The judge denied a motion by Eisenhauer’s defense team to throw out evidence given by Eisenhauer before he had asked for a lawyer and was arrested in January of 2016.
The judge did say statements made by Eisenhauer after he had asked for a lawyer would be determined under advisement until the morning of his trial.
The judge also denied the motion to suppress evidence from David Eisenhauer’s phone.
The judge ruled the police did have the right to take his phone and search for evidence when they had received the proper search warrant.
Eisenhauer’s trial is set for February 5th according to online court records.
