Attorney for Roanoke gym speaks out after gym owner charged by summons


ROANOKE, Va. (WFXR) — We’re hearing from the attorney of Titan Fit.

On Monday, we reported that the owner of the Roanoke gym, Thomas Milton was charged by summons for violating Governor Ralph Northam’s Executive Order 53 by staying open.

Under the executive order, gyms are considered a “non-essential business,” but Greg Phillips, the attorney, says Northam’s classification of businesses as “essential” and “non-essential” is unconstitutional.

“Under Virginia Code, §44-146.17, under state of emergencies, the Governor has the authority to coordinate emergency services, but he doesn’t have the ability or the legal justification to shut businesses down,” Phillips said.

The court date set for Titan Fit is Jul. 7 in Roanoke City General District Court.
